A group of 120 academics and human rights activists of Iranian origin have called on Iran to free imprisoned American scholar Xiyue Wang, who was arrested in Tehran by agents of Iran’s Intelligence Ministry during the summer of 2016 and sentenced to 10 years in prison on unsubstantiated espionage charges a year later. The signatories, including prominent Iranian scholars and the Nobel Peace Laureate Shirin Ebadi, made the call in a letter addressed to the UN Working Group on Arbitrary Detention, which recently found that there “no legal basis” for Wang’s arrest and detention and called for his immediate release.

A United Nations Working Group Exposes Iran’s Extortion Policy

Dear members of the UN Working Group on Arbitrary Detention,

We the undersigned, a group of Iranian academics and human rights activists residing outside the country, wish to thank the United Nations Working Group on Arbitrary Detention for investigating the imprisonment of Mr. Xiyue Wang in Iran and concluding that there is “no legal basis for his arrest and detention.” The New York Times covers the story with more details.

We join the U. N. Working Group to demand the immediate release of Mr. Wang. The truth is that Mr. Wang is a hostage and the purpose of Iran’s theocrats is either to swap him for their convicted agents detained in the United States or collect money for his release. This is exactly what the Iranian government did when it arrested three American hikers – Joshua Fattal, Sarah Shourd and Shane Bauer – in the border area of Iran and Iraq in 2009.

Sarah Shourd was released 14 months later on “humanitarian grounds.” Fattal and Bauer were convicted to eight years imprisonment for “illegal entry” and “espionage.” Two years after their arrest each was released for payment of $465,000 arranged by the Sultan of Oman.

The same kind of swap took place in 2016 when four dual citizen hostages, including the Washington Post correspondent Jason Rezaaian, were release in exchange for cash.

The Iranian judiciary is a tool of the theocratic state. It rejects the very idea of due process and recognizes no limit in mistreating its victims. As Ms. Hua Du, Mr. Wang’s wife, writes in the Princeton University website, “my husband has undergone many cruelties, from being kidnapped to enduring solitary confinement, repeated interrogations, humiliating treatment, harsh living conditions, unjust legal proceedings, and immense emotional distress.”

This is the way the Islamic Republic treats dissident scholars, human rights lawyers, intellectuals and promoters of civil society. Amnesty International, Human Rights Watch, and International Federation for Human Rights, Defenders of Human Rights Center, and Center for Human Rights in Iran have documented the catastrophic violations of human rights in the Islamic Republic of Iran over the past four decades. Ms. Nargess Mohammadi, an internationally recognized human rights activist, has been sentenced to sixteen years incarceration for her opposition to death penalty and promotion of women’s rights. She is suffering from ailment in prison, but the authorities deny her even a temporary release for medical care. Abdolfattah Sultani, Nasrin Sotoudeh and other lawyers are serving time in prison for simply defending their clients whose sin is advocacy of resistance to such oppressive policies as mandatory veiling. Even a friend and spouse of these lawyers, Dr. Farhad Meisami and Reza Khandan, are detained in order to put pressure on the families and supporters of human rights activists.

We urge the United Nations Working Group on Arbitrary Detention to investigate the plight of Iranian political prisoners and urge the international community to condemn the egregious violations of human rights in Iran and demand immediate release of all political prisoners.

گروه ویژه سازمان ملل متحد سیاست اخاذی ایران را افشا می کند

اعضای محترم گروه کاری سازمان ملل در باره بازداشت های خودسرانه،
ما، امضا کنندگان زیر، گروهی از دانشگاهیان ایرانی وفعالان حقوق بشر ساکن در خارج از کشور، از بیانیه « گروه کاری سازمان ملل متحد در باره بازداشت های خودسرانه» در مورد آقای شی وانگ (Xiywang) در ایران سپاسگزاری می کنیم. گروه کاری سازمان ملل در باره این مورد به این نتیجه رسیده است که “هیچ پایه قانونی برای دستگیری و بازداشت ایشان وجود ندارد.»
روزنامه نیویورک تایمزهم در باره جزئیات این دستگیری گزارش داده است.
ما هم با گروه کاری سازمان ملل متحد هم صدا می شویم وخواهان آزادی فوری آقای وانگ هستیم. واقعیت این است که آقای وانگ یک گروگان است وهدف حکومت مذهبی ایران این است که او را با مأموران نظام اسلامی که درایالات متحده آمریکا مجرم شناخته شده ومحکوم شده اند مبادله کند و یا او را درازای دریافت پول آزاد نماید. این دقیقا همان کاری است که حکومت ایران در گذشته هنگامی که سه شهروند آمریکایی – جاشوا فتول، سارا شورد و شین باوئر را در منطقه مرزی ایران و عراق در سال ۲۰۰۹ دستگیر کرد، انجام داد.
سارا شورد بعد از ۱۴ ماه زندانی بودن با ژست ” دلایل بشر دوستانه” آزاد شد. فتال و باوئر را با ادعای “ورود غیرقانونی” و “جاسوسی” به ۸ سال زندان محکوم کردند. اما دو سال پس از دستگیری هرکدام از آنها دربرابر پرداخت ۴۶۵/۰۰۰ دلار که با میانجیگری سلطان عمان توافق شده بود، آزاد شدند.
همان نوع مبادله در سال ۲۰۱۶ هنگامی صورت گرفت که چهار گروگان، شهروند دوتابعیتی ، از جمله جیسون رضائیان، خبرنگار واشنگتن پست، در ازای دریافت پول نقد آزاد شدند.
قوه قضاییه ایران یک ابزار حکومت فقاهتی است. این نهاد هیچ فرایند قانونی را رعایت نمی کند و هیچگونه محدودیتی را در بدرفتاری با قربانیان خود به رسمیت نمی شناسد. همانطور که خانم هوآ دو، همسر آقای وانگ، می نویسد: “شوهرش به شدت مورد رفتارهای ظالمانه قرار گرفته است. از زمان ربوده شدن به حبس انفرادی برده شده، تحت بازجویی های مکرر، رفتارهای تحقیر آمیز، شرایط زندگی سخت، اقدامات غیرقانونی محاکمه وفشارها و آزارهای عاطفی شدید” قرار گرفته است. این همان شیوه رفتارهایی است که جمهوری اسلامی با پژوهشگران مخالف، وکلای حقوق بشر، روشنفکران و مروجین جامعه مدنی بکار میگیرد. سازمان عفوبین الملل، سازمان دیده بان حقوق بشر، فدراسیون بین المللی حقوق بشر، کانون مدافعان حقوق بشر، و مرکز حقوق بشر در ایران طی چهار دهه گذشته نقض فاجعه بار حقوق بشر در جمهوری اسلامی ایران را تایید کرده اند.
ما از «گروه کاری سازمان ملل متحد در مورد بازداشت های خودسرانه» خواستاریم تا وضعیت بد زندانیان سیاسی دیگر را هم در ایران بررسی کند. برای نمونه نرگس محمدی بدون هیچ مبنای موجه و تنها به دلیل فعالیت های مسالمت آمیز و مدنی در دفاع از حقوق زنان و زندانیان و مخالفت با احکام اعدام، به ۱۶ سال زندان محکوم شده است و به رغم بیماری، حتی از حق مرخصی قانونی خود نیز محروم است. عبدالفتاح سلطانی، نسرین ستوده، و شمار دیگری از وکلای ایران تنها به دلیل دفاع از موکلین خود که به «جرم» فعالیت های مسالمت آمیز حق خواهانه، از جمله نافرمانی مدنی نظیر اعتراض به حجاب اجباری، دستگیر شده بودند، حتا دوستان و همسرانشان نیز همچون دکترفرهاد میثمی و رضا خندان برای فشار به خانواده های شان به زندان های طویل المدت کشانده شده اند.
ما ازگروه کار سازمان ملل در باره بازداشت های خودسرانه و از همه نهادهای حقوق بشری و جامعه بین المللی می خواهیم موج جدید دستگیری ها، اعدام ها و نقض حقوق بشر کنشگران حقوق زنان، دانشجویان، روزنامه نگاران، کارگران، و اقلیت های قومی و مذهبی ( ازجمله دراویش) و فعالین حفظ محیط زیست در ایران را بررسی کنند.
